Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Aviatter — the aircraft-spotting application and related websites and services (the “Services”) — operated by Alan Richert (“Aviatter”, “we”, “us”). “Content” means any photos, text, location data, or other material uploaded to or appearing on the Services. By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Who may use the Services

You may use the Services only if you can form a binding contract with us and are not barred from doing so under applicable law. You must be at least 16 years old to use Aviatter (or at least 13 with verifiable parental or guardian consent where local law permits). See our Child Safety Standards.

2. Your account

Aviatter uses passwordless sign-in tied to your email address. You are responsible for activity on your account and for keeping access to your email secure. Some communications (such as service and administrative messages) are part of the Services and you may not be able to opt out of them. Notify us if you believe your account has been compromised.

3. Privacy

Our Privacy Policy explains how we handle your information. By using the Services you agree to that handling, including the processing and cross-border transfer of information as described there.

4. Your content and licence

You own your Content. You retain all ownership rights in the Content you post.

To operate the Services, you grant Aviatter a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, to resize or re-format), publish, and display your Content for the purpose of operating, providing, securing, and promoting the Services — including displaying public Content to other users and via share links and preview pages. We do not sell your Content, and we do not grant third parties the right to syndicate or redistribute your Content outside the Services. This licence ends when you delete your Content or your account, except where the Content has been shared with others who have not deleted it, or where we must retain it to comply with the law.

Public by default. Unless you mark a sighting private (an Aviatter Pro feature), your sightings are public. By posting public Content you direct us to display it publicly within the Services.

Your responsibilities. You are responsible for your Content and must have all rights necessary to post it and to grant the licence above. Do not post Content you do not have the right to share.

5. Acceptable use

You agree not to:

  • post unlawful, infringing, harassing, hateful, deceptive, or abusive Content, or impersonate others;
  • post, solicit, or facilitate any child sexual abuse or exploitation (CSAE) material or conduct — we have zero tolerance for this (see our Child Safety Standards);
  • probe, scan, or test the vulnerability of the Services, or breach or circumvent security or authentication measures;
  • access the Services other than through our published interfaces, or scrape the Services without our consent (crawling in accordance with our robots.txt is permitted);
  • interfere with or disrupt the Services or place an undue burden on them (for example through malware, flooding, or spam).

We may remove Content, and limit, suspend, or terminate accounts, that violate these Terms or that create risk or legal exposure.

6. Moderation and reporting

User Content is subject to automated and human moderation. You can report Content from within the app. We may remove Content and take action on accounts in accordance with these Terms and our standards. We do not guarantee that we review all Content, and you may encounter Content you find objectionable; all Content is the responsibility of the person who posted it.

7. Subscriptions and payments

Aviatter offers optional paid features (“Aviatter Pro”). Subscriptions are sold and billed through the Apple App Store or Google Play under their terms, and — unless you cancel — renew automatically. You manage and cancel subscriptions through your app-store account. Refunds are governed by the applicable app store’s policies. Features and pricing may change; we will not reduce paid features you have already been billed for during a billing period without a fair remedy.

8. Intellectual property

The Services (excluding user Content) — including the Aviatter name, logo, software, and design — are owned by us and our licensors and are protected by intellectual-property laws. We grant you a personal, worldwide, royalty-free, non-assignable, non-exclusive licence to use the app solely to enjoy the Services as permitted by these Terms. Nothing here grants you rights to our brand features. Any feedback you provide may be used by us without obligation to you.

9. Ending these Terms

You may stop using the Services and delete your account at any time from within the app. We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms or created risk or legal exposure, if required by law, or if providing the Services to you is no longer viable. We will make reasonable efforts to notify you. Sections that by their nature should survive termination (including 4, 5, 8, 10, 11, and 12) will survive.

10. Disclaimers

The Services are provided “as is” and “as available”. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that Content is accurate or reliable. Your use of the Services and any reliance on Content is at your own risk, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Aviatter and Alan Richert will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Services. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. General

These Terms are governed by the laws of the Republic of South Africa. We may revise these Terms from time to time; changes are not retroactive, and the current version at aviatter.com/terms-conditions governs. By continuing to use the Services after changes take effect, you agree to the revised Terms. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
